"‘The Regulation of the Legal Profession in Ireland’"
Abstract: This thesis explores the current system for the regulation of the legal profession in Ireland, and the changes which are likely to occur following the EU/IMF bailout. Part I considers the present regulatory framework, including the role of the key professional bodies; The Law Society of Ireland, The Bar Council of Ireland and The Honorable Society of King’s Inns. It also looks at the role of legislation and statutory instruments, and informal or soft regulatory influences such as insurance providers and the effect of peer pressure upon practitioner behaviour. International influences on the regulation of the legal profession are also examined, and the problems and shortcomings in the present regulatory framework are identified. Part II looks at the impact of the EU/IMF Troika on the regulation of the legal profession in Ireland. It analyses the provisions of the new Legal Services Regulation Bill (LSRB) 2011 and considers how the Bill, if enacted in its present form, will impact upon the present regulatory system. Comparisons with the regulation of the legal professions in other bailed out countries are made. Part III presents a case study investigating the likely impact of the LSRB 2011 upon patterns of professional misconduct amongst solicitors.
Maeve is currently researching the regulation of the legal profession in Ireland. She hopes to participate in the Regulation Research Group which is due to commence in the summer of 2012 at NUIG.
