Study on challenges and good practices in the implementation of the UN Convention on the Rights of Persons with Disabilities

In January 2009, the European Foundation Centre launched the Study on challenges and good practices in the implementation of the UN Convention on the Rights of Persons with Disabilities. The Study is executed for the European Community, represented by the European Commission’s Directorate General Employment, Social Affairs and Equal Opportunities under the contract VC/2008/1214. The Study aims to analyse the obligations set out by the Convention and to gather information about the various practices in the implementation of the Convention at EU and Member State level, from both a legal and practical point of view. It seeks to identify challenges and measures to facilitate the achievement of the objectives laid down in the Convention. By doing so, the Study aims to provide help and guidance to Member States, the European Community and other stakeholders on implementing the Convention.

The European Foundation Centre manages the Study. Research is carried out by a team of academics and researchers with a range of expertise on international, community and national law. Organisations of persons with disabilities are also involved in the Study by way of the civil society panel, which ensures that research is practical and focuses on key issues.

The Centre for Disability Law and Policy is involved in producing a number of deliverables for this Study, namely:

• An overview of Member States’ legislation that needed or needs to be adjusted to comply with the Convention.
• A list of key actors at Member State level which are responsible for the implementation of the Convention, relating them to the various requirements of the Convention and identifying their role and contribution to the process of implementing the Convention.
• A compendium of good practices in the implementation of the Convention covering both legal and relevant practical measures in the Member States.

The Centre, in conjunction with all Study partners, will also assist in preparing concluding recommendations and guidelines for Member States and the EU on how to implement the Convention to achieve its objectives.
