Policies & Procedures: Recruitment: Legal Framework of Recruitment - Indirect Discrimination
Legal Framework of Recruitment
- Indirect Discrimination
This consists of applying a requirement or condition, even without intent, which adversely affects significantly more of one of the groups covered by the legislation than the population in general and which cannot be objectively justified. A height requirement, for example, where this would not be job related, could be indirectly discriminatory against women.
