The Right of the Child to Life, Survival and Development
The concept of survival and development is crucial to the implementation of the whole United Nations Convention on the Rights of the Child (UNCRC). Article 6 (2) of the United Nations Convention on the Rights of the child states the right of the child to survival and development:
"States Parties shall ensure to the maximum extent possible the survival and development of the child."
The Committee on the rights of the child specified article 6 as a "General Principle".
In addition, the Committee on the rights of the child has emphasized that it sees child development as a holistic concept that embraces the whole convention. In the Reporting Guidelines to Governments, the Committee requires States
"To create an environment conducive to ensuring to the maximum extent possible the survival and development of the child, including physical, mental, spiritual, moral, psychological and social development, in a manner compatible with human dignity, and to prepare a child for an individual life in a free society."
The term "survival" has a comprehensive meaning within the United Nations context, specially, for the World Health Organization (WHO) and United Nations Children's Fund (UNICEF). It includes food, immunization, growth monitoring, female literacy, oral rehydration and disease control, breastfeeding and child spacing.
My research is concerned with the interpretation of article 6(2). It analyses the existing interpretations and definitions of the right of the child to survival and development. In addition the research will, possibly, formulate a new well defined and comprehensive definition incorporating all the existing interpretations within a legally challenging context.
