Biography

Shivaun Quinlivan is a graduate of NUI, Galway, King’s College London and The Honourable Society of King’s Inns. Shivaun has recently completed a PhD in Trinity College Dublin; her research addressed the efficacy of public interest litigation in the context of the right to education for children with disabilities.   Shivaun has been a lecturer at the School of Law, NUI Galway since September 2000 where she teaches primarily in the area of Constitutional Law and Disability Law and Policy on a variety of programmes.

Shivaun’s research interests focus on the rights of people with disabilities, with a particular focus on education and employment.  In that capacity Shivaun has worked with and for a range of statutory and other agencies in Ireland and Europe: including the Equality Authority, the National Council for Special Education, the Association of Higher Education Access and Disability, the Health Service Executive as well as working on a number of European Commission funded projects.   Guided by both her practical and academic knowledge in this area Shivaun has developed, on her own and in conjunction with colleagues a number of new courses over her time in the School of Law including Education Law and Policy and Disability Law: Contemporary Law Reform Challenges in the National and International Sphere.  This experience has ensured that Shivaun was appointed as the Director of the new LL.M. in International and Comparative Disability Law and Policy that will commence in September 2011.  See: http://www.nuigalway.ie/cdlp/llm.html  Shivaun is a member of the management committee of the Centre for Disability Law Reform.

 
 

Research Interests

Shivaun's research interests focus on the right to equality with a particular interest in disability rights.  Much of her research is on the right to education, as well as non-discrimination principles as applied to people with disabilities.  Shivaun is primarily interested in the practical application of her research, to that end she is interested to know whether equality legislation or litigation actually result in an improvement of the life situation for people with disabilities.  To that end she is currently undertaking a PhD which is looking at the benefits, strengths and weakness of public interest litigation in the context of the right to education for children with disabilities. 

She has in the past been a member of a number of EU Networks of Legal Experts that assessed the incorporation of the Race Directive (2000/43/EC) and the Framework Employment Directive (2000/78/EC).  These projects aimed to assess throughout the then 25 Member States of the European Union the impact of these non-discrimination directives. 

Shivaun is also keen to disseminate legal knowledge and has been involved in several projects that provide training, for example from 2004-2006 she acted as a project consultant on disability discrimination with the European Disability Discrimination Project.  More recently she provided training to members of the judiciary on EU Disability Law and the UNCRPD (United Nations Convention on the Rights of Persons with Disabilities), this was provided through ERA-Academy of European Law, Trier, Germany.  This is part of the European Union’s Programme for Employment and Social Solidarity - PROGRESS (2007-2013).  Shivaun is also working with the HSE’s project Children First, which provides training for the trainers. 

Shivaun’s research also guides her teaching and as the Director of the new LL.M. in International and Comparative Disability Law and Policy she has been integral in the course development for that programme.  The first public LL.M. event a conference on Employment and Mental Health will be held in conjunction with the School of Law’s Clinical Legal Education Programme, and the Employment Law Lawyers Association, in November 2011.
